A few seconds difference in the track length is not a problem, something
like
http://wiki.musicbrainz.org/WhatDefinesAUniqueRelease#head-c47c5937115364dab3e9d6208dac621b9353485d would apply here, too. And if there is more significant difference, the tracks shouldn't be merged.
