As the name is not copyrighted, you are keeping anyone else from using 
it in/for their own products, which is the extent I would find  
acceptable.
I do see your point in enforcing validity when using XSPF, but I also 
believe it should not be by law; someone using it should not have to 
fear monetary penalties when doing it the wrong way.
